Matt Binder settled with Pacifica out of court about two months ago.
You
may remember him as the person who researched, wrote and got the million
dollar grant for the Human Genome Diversity Project. After working on the
project for 3 years he found that Bari Scott, then Third
World Department
head and - I believe - Executive producer of the project kept a double
set of books. Keeping two sets of books on a grant from he National Science
Foundation and the Department of Energy is a serious
violation of the
disclosure requirement of that or any grant and Matt Binder went to Pat
Scott and asked her to make sure that Bari was not paying herself an additional
salary and not using funds from the grant to
build her own studio.
Also it seemed that Bari was not doing any real work on the grant although
she was paid and Matt wanted to ascertain how many hours of work she was
claiming. Pat Scott immediately fired Matt Binder. She sided with Bari
without an investigation and without even meeting with Matt to discuss
the matter .
Marci Lockwood, then
the GM at KPFA, wrote a letter to the local board. I don't have the
text in front of me but remember from the tenor that it told the board
members that Matt was justifiably fired for incompetence.
Regardless of the
exact content what she wrote then was totally incorrect. The outcome of
the law suit, the discovery all show that. Whether she openly lied or just
did not care to investigate before she made these
statements is up
for others close to her to decide. It is not appropriate for any staff
person to lie to the board.
Anyway, Matt Binder sued Pacifica for having fired him from a job that he himself created and he sued essentially for being paid for the work he did and for being given the proper credit on the completed project. Pacifica hired Michael Couzens to represent them although he does not know much about employment law, being an FCC lawyer. Michael's wife, by the way, is the famous radio producer Adi Gevins who is Bari Scott's best friend.
When finally Couzens realized that he could not win the case for Pacifica they settled for $25,000 and gave Matt a letter of recommendation so he will be able to account for the last 5 years for any future job. Matt could have gotten more money but he simply wanted to be paid for the work he did and have his name cleared after all the slander that came from Marci and others at KPFA and Pacficia.
However he was unable
to get his name on the credits. Bari Scott had taken the million dollar
project out of KPFA and build her own studio called Sound Vision. She refused
to give the credit and Pacifica can't
force her any more
to do so since she is no longer employed there.
Matt is now suing Bari.
The whole thing is totally crazy.
Pacifica fires a
guy who has just brought a $1 million Allows Bari Scott to run off with
the project and the money
Pays a lot of money
to Couzens who loses them the fight Incurs audits from DOE and NSF inspectors
Probably ruined
their chances of future grants
